FORMAL COMPLAINT

jtodd1.jpgI would wish to make a formal complaint against your Community Paramedic Officer, Jamie Todd who yesterday refused to admit my elderly father (77) to a proper NHS hospital following my visit to Needwood Nursing Home, Heath Hayes whereby I witnessed that my father had been subjected to abuse and neglect, yesterday's visit followed formal complaints to Staffordshire Police regarding the same.

denied1.jpgHaving seen my father on Tuesday 4th November 2003 at approximately 14.05 hours in a semi conscious condition I then asked the staff at Needwood Nursing Home for an explanation as to how he had became semi conscious, the staff then failed to provide a plausible account and so I telephoned the emergency services for an ambulance at approximately 14.20 hours for the purposes of transporting him to a NHS hospital for a proper medical examination and suitable treatment as a I had an honest belief that he was suffering from, inter alia, internal injuries. Within five minutes the ambulance arrived and I then approached the two technicians and briefed them as above. The technicians then entered the premises but I was excluded and had to wait outside the building. Approximately 15 minutes later Mr. Todd arrived and entered the premises, shortly thereafter he came out and collected two cases from his vehicle, then returned to the premises, again I was not allowed in the building and Mr. Todd didn't approach me or introduce himself or suggest I should be involved in the assessment as next of kin.

Approximately 5 minutes later the two ambulance technicians came out of the building and one of them said "we're in a rush" and then preceded to drive their ambulance down Stafford Street with the emergency lights in operation, it was then I became alerted to the fact that the decision had already been taken not to admit my father to an NHS hospital but had done so without consulting me. Approximately 15 minutes later Mr. Todd then emerged from the building and walked to his vehicle completely ignoring me, from his actions it was clear he was intent on driving off without having the decency of informing me of what was happening.

Having witnessed this I then approached Mr. Todd and asked him if he was in charge now that the ambulance had gone, he then replied "I am, yes" and then asked if I was Mr. Edgar, to which I replied "yes" thus his question confirmed that he knew who I was but still chose to ignore me, he then said he had spoken to my father's own GP which clearly must have been via the telephone as the GP was not on the premises when I arrived and clearly did not attend thereafter as I was outside the building all of the time. Mr. Todd then said that "the GP had seen my father today and that he was happy for my father to stay here under the care of Needwood House and that's what the GP believes is in your father's best interest, and so we're happy with that"

I then asked Mr. Todd to state his name and position, Mr. Todd then confirmed his name and that he was a Community Paramedic Officer working for Staffordshire Ambulance Service. I then asked him if he was a Consultant in geriatric care, he replied "I am not" I then asked him if he carried X-ray equipment in his bag, he replied "I don't" I then asked him if he carried MRI scans and other similar equipment, he replied "I don't" I would comment that in answering these simple questions in order to establish his medical credentials he appeared from his facial expressions to find it some what amusing, this I found to be particularly offensive as he was clearly playing God and had already decided my elderly father was to die without any hope of a proper medical assessment and treatment or the right to a second opinion from a qualified Consultant, this gives rise the a different interpretation of the abbreviation NHS: No Hope Supplied.

Having obtained this information I then put it to Mr. Todd how he could assert whether my father had been physically abused or neglected without admitting him to a proper hospital under the care of a proper Consultant, Mr. Todd then deliberately avoided answering the question, passed the buck and said "if you want to discuss that matter I should discuss it with the patient's GP" I then replied by stating that "I was not interested in the patients GP as he also is not a Consultant", I also emphasized that "he was the last shot here and he will take the blame if the patient dies in Needwood House". Mr. Todd responded by saying that "we have looked at the patient and we have spoken to the patient's GP, and the GP is happy for the patient to stay here. Having established that the ambulance technicians had already left this meant that he was the only independent medic on the premises therefore his constant referral to "we" has to be with none medical personal, no doubt the owners of Needwood House where undoubtedly my deliberate exclusion was to facilitate in the "cozy" arrangement between Mr. Todd, Needwood House and the GP who would clearly wanted matters kept under wraps so as not to exposes his obvious knowledge of the abuse and neglect.

I then informed Mr. Todd that he had denied him the right to life, I then asked him if he had come across the Human Rights Act, I also informed him that there was a Human Rights case going on with Needwood and that he will become part of it, I then asked him if he would be happy with that? Once again by his facial expressions he clearly found it amusing as I put it to him that he is denying him the right to live. He replied that he did not agree with me on that and that "we're acting in the patient's best interest which is what the law is all about" I then responded by saying "you can't possibly know what the patient's best interest are until you have had him properly examined by proper people with proper equipment, you don't have that, you just said it" so how can you possibly come to any conclusion as to what his state of health is or isn't", he then repeated that "he was acting in the patient's best interest" I then said your not acting in his best interests and that in truth you don't want a "bed blocking" situation so your quite happy to see him pass away in this "shit hole", that's the bottom line, isn't it? Now completely embarrassed as he was being observed by two police officers and others he stated that "he really can't discuss that" I then informed him that I would be making a formal complaint about him, he then turned his back on me and said "that's fine".

I would therefore formally complain that Mr. Todd who is not a qualified Physician or a Consultant in geriatric care and therefore does not possess the specialist skills required, nor is he a Consultant in any other medical field or discipline and by his own admittance did not have suitable specialist equipment at the material time in order to establish if my elderly father had internal injuries or any other injuries or disorders.

I would also complain that Mr. Todd knowing I was next of kin and that I had called the emergency services deliberately excluded me from his assessment and furthermore failed to obtain relevant information from myself prior to entering Needwood House, in particular failed to consider the formal complaints made to Staffordshire police with respect to abuse and neglect and the obvious implications of my elderly father's GP being allowed to cover up his own professional negligence and incompetence, the same formal complaints which were earlier brought to the attention of the two police officers who later attended Needwood House whilst Mr. Todd was present.

Furthermore I would also complain that Mr. Todd failed to take the opinion of a Consultant Geriatrician or similarly qualified medical physician but relied entirely upon the verbal representations of a GP who was not in attendance and was in any event subject to a formal complaint to Staffordshire Police with respect to abuse and neglect of the same patient he was allegedly assessing.

I would also complain that Mr. Todd deliberately attempted to leave Needwood House without informing me of what was going to happen to my elderly father, in addition would complain that the owners of Needwood House and my father's incompetent GP unduly influenced Mr. Todd, furthermore his decision to deny my father proper medical treatment and care was in keeping with and influenced by the NHS "bed blocking" policies which deliberately deprive elderly patients from being admitted to NHS hospitals.

I would formally complain that contrary to Article 2 of the Human Rights Act 1998 and Human Rights Convention Mr. Todd has breached my father's right to life and furthermore has failed to take reasonable measures to protect life by deliberately denying him access to proper medical care and treatment and if my father subsequently dies as a result of his callus attitude I will hold him personally responsible and the enclosed video images and the footage I have of his behavior will be forwarded to Strasbourg, the national press and placed upon various sites on the Internet.

I would therefore ask you investigate this formal complaint.
