Delay in GMC hearing breached doctor's human rights This is a case at the General Medical Council concerning a doctor who argued that his rights under Article 6 of European Convention on Human Rights were breached due to delays in the hearing. The case was described in the BMJ. The BMJ stated “A surgeon who has been suspended on full pay for nearly four years won an unprecedented legal victory last week when the General Medical Council agreed to drop its case against him on the grounds that delay had breached his right to a fair trial under the Human Rights Act” The GMC preliminary hearing can be downloaded from here. The BMJ Article on the case can be downloaded here.
